Terms & Conditions

DEFINITIONS:

In these Membership Terms, “we” or “us” means Zippy Opinion, and a reference to “you” or “your” means a Member or Individual. A Member is a respondent who signs up by creating an account and accepting these Membership Terms and the Privacy Policy. “Survey” refers to the questionnaire presented on the survey site. “Panel” refers to a collection of individuals who have agreed to be invited to participate in research studies or market surveys. “Survey Site” refers to the Zippy Opinion website where you can answer our surveys.

INTRODUCTION:

Zippy Opinion is a unit of Markelytics Solutions Pvt. Ltd., a leading provider of online panel services, available through the website zippyopinion.com and/or the Zippy Opinion app. The purpose of these terms is to set out the general terms and conditions for your participation in our surveys. By registering with Zippy Opinion, you agree to abide by and be bound by the Privacy Policy of the company and these general user conditions set by Markelytics Solutions Pvt. Ltd., which may be modified at any time without prior notice. Consequently, it is recommended that you refer to the latest version of the Terms & Conditions regularly, which are available on the site at all times. Your continued participation in the Service constitutes your agreement to these terms.
IF YOU OBJECT TO ANY OF THE TERMS AND CONDITIONS OR ANY SUBSEQUENT MODIFICATIONS, YOUR ONLY RECOURSE IS TO IMMEDIATELY DISCONTINUE PARTICIPATION IN ZIPPY OPINION AND TERMINATE YOUR MEMBERSHIP.

CONDITIONS FOR SURVEY PARTICIPATION:

As consideration for your participation in our surveys and use of our survey site, you agree to comply with these terms, as well as any other applicable conditions, including any agreement between you and Zippy Opinion. Your participation in a survey and use of the survey site must comply with applicable laws.
By participating in our surveys, you agree to provide true, accurate, current, and complete information about yourself when prompted. If you provide any information that is untrue, inaccurate, not current, or incomplete—or if there are reasonable grounds to suspect such information—you may be disqualified from the survey and may not receive any points or incentives. In addition, Zippy Opinion may terminate your membership account and refuse your current or future participation in surveys.
This agreement is a contract for the provision of services. Nothing in this Agreement shall create, or be deemed to create, a legal partnership, agency relationship, or employer-employee relationship between you and Zippy Opinion.
All data and information collected will be used for research and analysis and/or for creating a data bank and/or various reports, which may be shared with our clients including, but not limited to, telecom service providers, mobile phone manufacturers, value-added service providers, advertisers, brands, marketers, app developers, etc. The information/data will not be shared with third parties in a manner that would enable the identification of any specific individual.
You are permitted to have only one (1) account. You are responsible for all access or use of the site that occurs in conjunction with your username and password. Use of your username and password constitutes conclusive evidence that you have accessed the membership sections of the site.
You must keep your username and password confidential. Zippy Opinion will not be responsible for any losses incurred due to the use of your password by a third party, except when such unauthorized use is directly attributable to the gross negligence or fraud of Zippy Opinion. You must not allow any third party to access the site using your credentials.

VALIDATION:

  • Survey Speeding: For verification and security purposes, a survey may have an estimated completion time. If you complete the survey in a timeframe that falls outside the estimated duration, you may be deemed not to have finalized the survey and may not receive any incentives for participation. Zippy Opinion may also terminate your membership.
  • Red Herring Questions:A survey may include repeated or specially designed questions (so-called “Red Herring Questions”) to ensure that you are reading carefully and responding truthfully. If your responses to such questions indicate inattentiveness or dishonesty, you may be disqualified and may not receive any incentives. Your membership may also be terminated, and your account deleted.
  • Open End Questions: Some surveys may include sections requiring typed answers (as opposed to fixed-response selections). If such answers contain inappropriate or irrelevant language, you may be disqualified and will not receive any incentives. Your membership may also be terminated.

YOUR CONDUCT: BY PARTICIPATING IN THE SURVEY OR USING THE ZIPPY OPINION SURVEY SITE, YOU AGREE:

Not to disrupt, interfere with, or otherwise abuse the service or the Zippy Opinion survey site, or any systems, accounts, servers, or networks connected to it.

  • Not to disrupt, interfere with, or otherwise abuse the service or the Zippy Opinion survey site, or any systems, accounts, servers, or networks connected to it.
  • Not to interfere with another user’s enjoyment of the survey or affiliated sites.
  • Not to upload, post, or transmit any viruses, harmful files, programs, or code.
  • Not to use another user’s account or create/use a false identity without authorization.
  • Not to transmit spam, chain letters, junk mail, or unsolicited messages.
  • Not to attempt to gain unauthorized access to restricted areas of the survey site.

You agree to be solely responsible for all actions and communications transmitted through your account and to comply with all applicable laws related to your use of the site.

Suspension: Your access may be suspended or terminated if you fail to comply with these terms, participate unlawfully, or act in a manner detrimental to Zippy Opinion.

INTELLECTUAL PROPERTY:

Unless otherwise stated, all materials—including concepts, text, designs, graphics, photos, videos, sounds, trademarks, and trade names—are subject to intellectual property rights held or licensed by Markelytics Solutions Pvt. Ltd.
No license is granted to use, reproduce, distribute, or post any such content. Legal action may be taken against any unauthorized use.

POINTS-BASED INCENTIVE PROGRAMS:

To earn points, you must successfully complete a survey. No purchase is required. Points available for each survey are specified at its start. You are responsible for any taxes resulting from points or incentives earned.
Participation may be suspended and points voided for any breach of rules or misrepresentation. Zippy Opinion is not liable for any resulting consequences.
You can register by clicking on a banner ad or email survey URL. Registration includes answering profiling questions. To be eligible for prize draws, online registration, and account activation are necessary.
Zippy Opinion disclaims all warranties related to partner websites involved in point redemption. Points can be redeemed for gift vouchers or donated to charity. Redemption starts at 1000 points. Rewards will be received within 4–6 weeks from the date of redemption.

OBLIGATIONS OF ZIPPY OPINION:

Determine your eligibility for surveys.

  • Credit your account with the specified amount for completed surveys.
  • Allow you to redeem reward points once the threshold of 1000 points is reached.
  • Randomly select members for surveys based on client requirements.
  • Occasionally conduct pre-screening without offering incentives.
  • Reserve the right to substitute rewards or change the value per survey.
  • Deduct any credited amounts if terms are violated.

OBLIGATIONS OF THE MEMBER:

Members must:

  • Be 18 years or older.
  • Not be corporations or business entities.
  • Be legal residents of the country the panel is based in.
  • Register only once.
  • Not attempt to participate multiple times using different identities.
  • Provide honest and meaningful answers.
  • Take responsibility for declaring any income received from Zippy Opinion.
  • Follow the procedures outlined on the website to claim rewards.

LIMITATION OF LIABILITY:

To the extent permitted by law, Markelytics Solutions Pvt. Ltd. shall not be liable for any direct or indirect damages—including loss of profits, savings, or other non-direct damages—related to this agreement or your submissions.
These limitations apply regardless of the legal basis of your claim and survive any failure of the essential purpose of the contract or exclusive remedy.

DATA PROTECTION:

Any personal information you submit to Zippy Opinion will be handled in accordance with our Privacy Policy.

RIGHTS TO CHANGE AND CONTROL WEBSITE:

Website content may be changed, restricted, or terminated without notice. Features and services may be updated, and this may result in changes to this agreement. Continued use of the website after such updates constitutes your acceptance of the changes

APPLICABLE LAWS & JURISDICTION

These Terms of Use shall be governed by applicable laws, without regard to conflict of laws principles. All disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the relevant courts.
